Terms and Conditions
These Terms & Conditions contain the terms, conditions and provisions upon which you may access and use the mingopress.com (“Sites”, “Mingo”, “Mingo Press”) website or any of the products or services available through the site. The terms “we,” “our,” and “us,” refer to mingopress.com, Mingo Press LLC, the owner and administrator of the Sites, and its officers, directors, employees, licensors, suppliers, vendors, content providers, partners, staff, affiliates, agents and representatives (collectively, the “Affiliated Parties”). You may be referred to as “you,” “customer,” or “user” in this Agreement.
By using this site, you are hereby accepting and agreeing to be legally bound by the terms and conditions contained herein. If you do not agree to all of the following terms and conditions, you are not authorized to use the site.
Mingo Press does not guarantee the security of information you transmit through the Web, and you send all such information at your own risk.
If you have any questions regarding proper sizing, color mode, resolution, bleed and live area, technical specifications or any general printing terms, please contact us at 1-855-696-4646.
Layout Accuracy :: You are solely responsible for the accuracy of your layouts. Please proofread all layouts carefully. Postal Regulations are subject to change and you are also 100% responsible for complying with current USPS Postal Regulations, where applicable. We take no responsibility for any copy or design errors committed on your part. We are not responsible for grammatical errors, incorrect dates or misspelled words in files submitted by you, or on jobs we typeset if you have approved a proof, online or hardcopy.
Mingo Press reserves the right to refuse to print any material that Mingo Press determines, in its sole discretion, is immoral, illegal or inappropriate for any reason. If your material is deemed unacceptable, you will be notified promptly and permitted to change the content or layout to fit our requirements. You will not be charged for any services that are performed by Mingo Press on any job that is denied for the reasons described in this paragraph.
Color Accuracy :: Mingo Press will reproduce color from submitted digital layouts as closely and accurately as possible, but cannot exactly match color and density because of limitations in the printing process, as well as neighboring image ink requirements. Mingo Press accepts no responsibility whatsoever for color variations between submitted images and the actual artwork or product they represent. All colors contained within any RGB digital file will be converted to Mingo Press’s CMYK color space. This may cause the RGB colors to visually change due to color space differences. You should also note that your computer monitor’s calibration affects the colors displayed on your monitor’s screen. The colors on the printed piece may differ from what you see displayed when viewing your layout via Mingo Press’s online proof approval process. Under no circumstances will we reprint a job for color variations that have occurred during the printing process. We will show you an online proof of your job shortly after receiving it in our production department, but actual time will vary depending on our current workload. No job will be sent to press without your approval. Please take note that an online proof is by no means an accurate color reproduction of your final printed piece. Its serves as an opportunity for you to check the layout, bleeds, crops and final text. If you need to send new artwork upon reviewing this proof, a $30 fee will be assessed. This fee is applicable each time you submit new artwork. If your order is color critical, Mingo Press strongly suggests you purchase a hard copy color proof from us.
Price Quotes :: All prices are quoted based on the following general terms and conditions, unless specifically stated otherwise in the written quotation. Prices quoted are based on our understanding of the job specifications given at the time of the request and are subject to review when artwork or hardcopy samples have been received. Unless otherwise stated, all price quotes are valid for 30 days. Please provide all instructions in writing. Instructions not provided in writing may lead to problems for which we cannot be responsible.
Payment :: The fees for Mingo Press products and services, which include the cost of processing, printing, shipping and/or mailing, and any other charges, are due and payable together with the submission of an order. Mingo Press requires pre-payment on all orders with the exception of certain customers pre-approved for Credit Terms. Mingo Press accepts Purchase Orders from government and educational institutions with prior approval and requires the submission of the PO number at the same time the order is submitted. Any amount due to Mingo Press, which is not paid, may result in non-delivery of the order, and interest charges as allowed by law. Customers are responsible for all related collection costs, legal fees and interest. All returned checks will be charged a fee of $25.
Sales Tax Policy :: Mingo Press is required to collect sales tax on purchases shipped to Oklahoma, or picked-up in Oklahoma. If your order qualifies for sales tax exemption in accordance with Oklahoma Sales & Use Tax Regulations you must provide Mingo Press with a Valid Oklahoma Resale Certificate. Mingo Press requires that resale certificates be provided at the time of order via mail, faxed to (918) 627-9173, or emailed to firstname.lastname@example.org.
Refunds and Cancellation :: No refunds of any nature will be granted once Mingo Press begins your order. Additionally, no partial refunds will be provided for work not completed and design and set up fees may still apply and be charged. All refunds, due to an overpayment on a particular account are available upon customer request.
Scheduling, Turnaround Time and Delivery :: The deadline for receiving art or approval to begin work on an order is 1:00PM CT. Production Times start only after Mingo Press receives final proof approval of your layout and summary of printing charges with no further changes per Mingo Press’s Approval Form. Mingo Press’s stated production business days are calculated in 24-hour increments. All correspondence regarding the order should include the job number (in the subject line of an email or on the outside of a package/envelope) to avoid any delay. Completion of your job within our quoted Production Time is dependent on receipt of your signed layout and final approval. Please account for additional time for delivery of your order, as the number of delivery days is dependent upon the delivery service you select. Mingo Press observes holidays throughout the year. Please add one (1) additional day to the Production Time, during holidays. Expected delivery date and Production Times are not guaranteed. Your order may arrive late due to unforeseen delays in delivery service, natural disaster, the breakdown of equipment, bad weather, etc. Mingo Press is not liable for damage caused by any service carrier. Carrier claims are limited to $100. Mingo Press accepts no responsibility for tracking the delivery of packages shipped via the custom shipping option. Pick up orders will be kept for 60 days from the delivery of the pick-up notification email. If the order has not been picked up from Mingo Press’s facility within 60 days, it will be shipped directly to the customer and customer will be billed for the applicable ground shipping rates.

By submitting an order, you agree to defend, indemnify and hold harmless Mingo Press, its parent companies, subsidiaries, affiliates, officers, directors, employees and independent contractors, from any claim, demand, damages, liability, costs and expenses including but not limited to attorney’s fees made by any third party due to or arising out of claim that the printed job breaches any copyright, intellectual property, trademark or privacy right of any person or organization. You represent and warrant that you own or have properly licensed all the rights to images and other content being reproduced on your order. You also agree that subject matter does not have to bear a copyright notice in order to be protected by copyright law. You further agree that no copyright notice has been removed from any material used in preparing your artwork for production.
Limited Liability :: The liability of Mingo Press, if any, for damages for any claim of any kind whatsoever, with regard to any order placed by a customer shall not be greater than the total amount of fees payable by the customer to Mingo Press for its products and services.
